Terms of Service

These Terms govern your access to and use of Thinkery (“the Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Overview
Thinkery is a digital thinking and writing tool that incorporates AI-powered features. The Service is provided “as is,” without guarantees of accuracy, reliability, or availability.
These Terms may be updated or modified at any time, with or without notice. Your continued use of the Service after any changes means you accept the updated Terms.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your location, to use Thinkery.
3. Accounts
You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it up to date.
We may suspend or terminate your account at any time if we believe you have violated these Terms or pose a risk to the Service.
4. Payments and Balance
Thinkery uses a prepaid balance system. You can add funds to your account, and usage of the Service deducts from that balance.
- All payments are final and non-refundable unless required by law.
- If your balance is insufficient, the requested action will not be processed.
- Rates, pricing, and deduction formulas may change at any time, with or without notice.
- Payments are processed by third-party providers (e.g., Stripe), whose terms also apply.
Your balance has no cash value outside the Service and cannot be transferred, withdrawn, or converted back into currency.

5. Your Content
You retain ownership of the text, ideas, uploads, and materials you create or store using the Service (“Your Content”).
You grant the Service a limited, worldwide license to store, process, and display Your Content solely for the purpose of operating the platform and providing features to you.
We do not sell Your Content.
We do not use Your Content to train models unless an AI provider’s own terms require or allow it (see next section).
6. Use of AI and Third-Party Providers
Thinkery integrates third-party AI models (such as Google Gemini, OpenAI, or others). By using AI features, you understand and agree that:
- Your prompts and data may be processed by those AI providers.
- Their privacy policies and terms govern how they treat your data.
- AI output may be incorrect, incomplete, biased, harmful, or misleading.
- AI should never be relied upon for medical, legal, financial, or safety-critical decisions.
Absolutely no reliance clause
You agree that you will not rely on AI-generated content for any real-world decision where accuracy or safety matters. You acknowledge that AI output may be fabricated, mistaken, or dangerous.
No responsibility for AI output
The Service is not responsible for any harm, loss, decision, or outcome that results from using or relying on AI-generated content. You use AI features entirely at your own risk.
7. Acceptable Use
You agree not to:
- Violate any laws using the Service
- Attack, disrupt, reverse-engineer, or interfere with the platform
- Upload illegal, harmful, abusive, or infringing content
- Use the Service to build competing datasets or AI systems
- Misrepresent AI output as factual or expert advice
Violations may result in suspension or termination.
8. Privacy
A separate Privacy Policy describes how data is collected and handled. By using the Service, you consent to that policy.
9. Disclaimers
The Service is provided “as is” and “as available.”
To the fullest extent permitted by law, the Service:
- Makes no warranties of accuracy, reliability, or uninterrupted operation
- Does not guarantee that AI outputs are correct or suitable for any purpose
- Is not responsible for any loss of data or content
Use the Service at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is not liable for indirect, incidental, special, consequential, or punitive damages.
- Total liability for any claim is limited to the amount you paid to the Service in the preceding 12 months.
- If you have paid nothing, liability is $0.
Some jurisdictions don’t allow all limitations; only the permissible parts apply.
11. Modification or Discontinuation
The Service may change, suspend, or discontinue features at any time. We will provide notice when reasonable, but are not obligated to maintain specific features indefinitely.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if we believe you violate these Terms.
Upon termination, Your Content may be deleted after a reasonable period unless otherwise required by law.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada, regardless of conflict-of-law rules.
Any dispute must be resolved in courts located in Ontario.
